Marriage Laws: Best chance in a lifetime for equality

BettyJean Kling

For the first and I hope last time under this President and Congress, I am appreciating the progressive administration. I am grateful for Federal Judge Walker. If that’s what it takes to get equal justice for every citizen – then I will be grateful to this administration for ending this scourge on humanity our majority has so long held dear to the detriment of human dignity.

How dare anyone suggest the Judge should have recused himself because he is gay? Perhaps all the straight judges who voted against same sex marriage ought to recuse themselves for being straight!

As expected it was immediately set for appeal. Next, it will go to the 9th Circuit- and for the first time- I am glad that court is as liberal as it is shown itself to be. Apparently it will be a slam dunk for Gay Rights as well.

Finally it will go to the highest court in the land which just got it’s newest and possibly most progressive Justice yet! From there it can either become law of the land or go back to the states. Time will tell but if we have any sense at all we would do well to remember not to abuse the power of the majority.

“Bear in mind this sacred principle, that though the will of the majority is in all cases to prevail, that will, to be rightful, must be reasonable; that the minority possess their equal rights, which equal laws must protect, and to violate would be oppression.” –Thomas Jefferson: 1st Inaugural, 1801

14th Amendment no State shall ‘deny to any person within its jurisdiction the equal protection of the laws.’ To deny marriage is to deny equal protection to same sex partners that is given to hetero partners.
