Nebraska’s Immigration Law: Follows Arizona’s who follows Missouri’s

“I support the immigration laws 100 percent, because, going back to my grandmother and grandfather again, they were very proud that they became American citizens. … I am not saying I don’t want you to be an American, but do it the right way. Do it legally. We are a nation of Laws. BJK”

The Obama Administration intends to sue the state of Arizona over recently passed immigration laws.   Hillary Clinton offered that tidbit in Ecuador on June 20th and a Justice Department spokesman confirmed that the DOJ was building a case against Arizona and would likely bring suit in the near future. The nation is firmly behind these laws polling at 70% approval. Carefully crafted these new laws clearly agree with the Federal laws which are not being enforced.  

Residents of the small Nebraska town of Fremont have passed a controversial law aimed at ridding the town of illegal immigrants despite warnings that it could mean higher taxes and cuts in city services, the Omaha World-Herald reports.

The ordinance, which passed by a 57% to 43% margin, would fine landlords and employers in Fremont who house or hire illegal immigrants.

Officials in this town of 25,000 just west of Omaha say it could cost up to $200,000 a year to enforce the law and up to $1 million to fight expected legal challenges.

“You’ve got to take a step,” Jerry Hart, a leader of a petition drive to put the ordinance on the ballot, tells the newspaper. “You’ve got to do something.”

Hispanics make up about 8% of the town’s population, compared to about 4% in 2000. The newspaper says immigrants, drawn largely by jobs at meatpacking plants just outside the city limits, account for about 85% of the town’s growth this decade.

Many new towns , cities and states will be following as evidenced by Nebraska today however, over the last five years Missouri has systematically put in place the provisions recently enacted by Arizona without facing federal suit or threat of suit. Missouri laws are quite similar to those of Arizona, and they preceded the Grand Canyon State’s law.

Some of the highlights of the bill include:

– “43.032. 2. No municipality shall enact or adopt any sanctuary policy.”

 -208.009. 1. No alien unlawfully present in the United States shall receive any state or local public benefit, except for state or local public benefits that may be offered under 8 U.S.C. 1621(b). Nothing in this section shall be construed to prohibit the rendering of emergency medical care, prenatal care, services offering alternatives to abortion, emergency assistance, or legal assistance to any person.

– 3. In addition to providing proof of other eligibility requirements, at the time of application for any state or local public benefit, an applicant who is eighteen years of age or older shall provide affirmative proof that the applicant is a citizen or a permanent resident of the United States or is lawfully present in the United States

– ”  3. All public employers shall enroll and actively participate in a federal work authorization program.”

– “302.063. The department of revenue shall not issue any driver’s license to an illegal alien nor to any person who cannot prove his or her lawful presence pursuant to the provisions of this chapter and the regulations promulgated thereunder. A driver’s license issued to an illegal alien in another state shall not be honored by the state of Missouri and the department of revenue for any purpose.”

– “2. There shall be a presumption that releasing the person under any conditions as provided by section 544.455 shall not reasonably assure the appearance of the person as required if the circuit judge or associate circuit judge reasonably believes that the person is an alien unlawfully present in the United States. If such presumption exists, the person shall be committed to the jail, as provided in subsection 1 of this section, until such person provides verification of his or her lawful presence in the United States to rebut such presumption.”

– “577.722. 1. It shall be unlawful for any person to knowingly transport, move, or attempt to transport in the state of Missouri any illegal alien who is not lawfully present in the United States”

 – Plus this amendment: 

” 28.824. All law enforcement officers shall inquire into the citizenship andimmigration status of any person under arrest for a violation of any state law or municipal ordinance, regardless of the person’s national origin, ethnicity, or race. In all such cases where a person indicates

that he or she is not a citizen or national of the United States, the law enforcement agent shall verify with the federal government whether the alien is lawfully or unlawfully present in the United States, under 8 U.S.C. 1373(c). If the alien is verified to be unlawfully present in the United States, the law enforcement officer shall cooperate with any request by federal immigration authorities to detain the alien or transfer the alien to the custody of the federal government.”

There are also penalties applied to businesses that knowingly hire illegal aliens.

 State Representative Will Kraus gives a good overview of the Missouri law in the Lee’s Summit Journal.

 Missouri also bans in-state tuition aid for illegal aliens at state junior colleges.

 So, why should the Arizona law be unpalatable when Missouri’s was never worth challenging?  The Department of Homeland Security estimated Arizona’s illegal population at 560,000 in 2008, while the Pew Hispanic Center estimates between 400 and 450 thousand back in 2005. Pew’s 2005 estimates for Missouri were between 35 and 65, so Arizona’s illegal population is larger than Missouri’s by about a factor of ten. 560,000 potentially new Democratic Party Voters and union members!

 But there is more, much more; Arizona is not just a repository but a portal, the figurative Gibraltar of the U.S.  According to the AZ Capitol Times:

 “Overall, illegal immigration through those two states, New Mexico and Arizona has declined from nearly 1.2 million in 2005 to 541,000 last year, according to the Border Patrol. In Arizona, illegal crossings fell from 578,000 in 2005 to nearly 250,000 last year – before the recent rise.”

So, last year a quarter of a million people came in through Arizona. Where did they go? Everywhere, and that is why the Obama Administration is desperate to prevent Arizona’s law from working. 

One leg of Obama’s plan to Democratic political hegemony, to a new New Deal, rests on opening the nation wide. What happened in Missouri is small potatoes, because the important thing is to get these people here, not to protect their rights. Unhappy illegals can leave Missouri for Illinois and prosper. PEW’s estimate for Illinois in 2005 was anywhere between 375-425 thousand illegals – ten times the number in Missouri – and that before the new laws were enacted. The worry is not about civil rights, but about keeping the flood of invading peoples coming.

 Fredo Arias-King, former foreign relations aid to Vicente Fox, explained back in 2006

“While Democratic legislators we spoke with welcomed the Latino vote, they seemed more interested in those immigrants and their offspring as a tool to increase the role of the government in society and the economy. Several of them tended to see Latin American immigrants and even Latino constituents as both more dependent on and accepting of active government programs and the political class guaranteeing those programs, a point they emphasized more than the voting per se. Moreover, they saw Latinos as more loyal and “dependable” in supporting a patron-client system and in building reliable patronage networks to circumvent the exigencies of political life as devised by the Founding Fathers and expected daily by the average American.”

After his first 100 days, President Barack Obama told a hand-picked crowd in Missouri:

 “we’re working to remake America.”

 And that, my friends, is Gospel Truth!

  1. I hope that every American, regardless of where he lives, will stop and examine his conscience about this and other related incidents. This Nation was founded by men of many nations and backgrounds. It was founded on the principle that all men are created equal, and that the rights of every man are diminished when the rights of one man are threatened. All of us ought to have the right to be treated as he would wish to be treated, as one would wish his children to be treated, but this is not the case.

    I know the proponents of this law say that the majority approves of this law, but the majority is not always right. Would women or non-whites have the vote if we listen to the majority of the day, would the non-whites have equal rights (and equal access to churches, housing, restaurants, hotels, retail stores, schools, colleges and yes water fountains) if we listen to the majority of the day? We all know the answer, a resounding, NO!

    Today we are committed to a worldwide struggle to promote and protect the rights of all who wish to be free. In a time of domestic crisis men of good will and generosity should be able to unite regardless of party or politics and do what is right, not what is just popular with the majority. Some men comprehend discrimination by never have experiencing it in their lives, but the majority will only understand after it happens to them.

    • Can you please explain to me where you see this as discrimination? Can you also explain what part of illegal you don’t understand? I am not against legal immigration- none of us would be here if not for immigration – but we are a nation of laws and everyone should have the same rights and that is to get in line and come in the right way. So where is the discrimination except from those who think they can just break the law come in at will and kill, steal and traffic others? Please explain yourself? You just keep bitching about the same thing over and over again – racism- where is the damned racism? I am getting sick and tired of your crap when all else fails you pull the race card! What race card- aren’t you lucky that these folks are a little darker skinned from the south- so you have race cards to pull?     • Benito- I just noticed your last name is Latino- I am an Italian myself and I can tell you that I never thought the Mafia had a right to murder innocents just because I was Italian.

      Please don’t lower yourself- these people carrying AK47’s and shooting border patrol and ranchers are not your relatives – at least I hope not. Some of these people are trafficking young girls as prostitutes.

      I am going to assume you came here legally and want others to do the same!     I am a woman so I do know first hand what
    Discrimination looks and feels like.

    When we are talking about the laws of this country
    as it refers to immigration we are not discriminating
    against a gender, race, religion, sexual preference
    Or for that matter National origin.
    Today’s Immigration law argument is focused on Mexico
    because Mexico is the country that borders the US from the south and Mexico is the country where its citizens are known to be the majority entering the US ILLEGALLY through the US border state of Arizona.
    Mexico has made itself the focus of US immigration law because the government of Mexico has ignored its responsibility as our neighbor to assist and control the securing of our shared borders. Mexican citizens are the focus because they are the large majority of those disrespectful the US by crossing the border ILLEGALLY

    If Mexico demands our respect then Mexico needs to start respecting the US by protecting her borders as we do with respect for Mexico.
    Mexican citizens desiring a life in the US are welcome but begin your life here as did those who came before you did with a deep respect for the laws of this country and its people.
    The moment you step foot in this country be aware that those who came before you held their breathe not in fear of being caught, but held their breath in awe of this land… AMERICA.

    Those who came before you considered their child born in the USA a gift to this country. A first generation born US citizen was not considered insurance to immigrant parents but rather a profound assurance to immigrant parents that their pride in this country will live on, above all else

    Those who came before you did not abuse Her…they embraced Her, Her Laws, Her language, Her citizens.
    They pledged their allegiance to protect her and their graves are marked with a symbol of their allegiance .. Her flag, Their Red, White and Blue.
    They proudly waved Her flag above all others. They saluted Her and Sang Her Praises. Why do you burn Her, curse Her and Spit on’re disrespectful to Americans and then you demand we respect you and the flag of your “homeland” ?
    Sorry respect is earned, Americans have fully supported those Mexicans as well as every other population who have broken into this country.

  3. If Benito lives in the US he can leave if he doesn’t like the laws which will hopefully begin to be enforced. Arizona’s new law is not discriminatory in any way whatsoever, and someone who sees it as such has a tainted view which is sympathetic to criminal illegal aliens. Apparently the word illegal is quite easy to ignore if it doesn’t suit one’s liking.

    The Latin illegals are vast in number, and their disrespect for our laws and unwillingness to learn our language and fit into our society is the cause of great discontent in our country. Their drain on public funds has become too great to ignore. Supporting this is profoundly bad for our country, and it is truly sad that so many bleeding hearts have no problem watching this happen while they naively believe “everything will be alright”.

    • It is sad that we are perceived as heartless or racist or inhospitable instead of sensible.

      I wonder how they would view it if one of their daughters were trafficked by one of these illegal bums or fed drugs or god forbid raped or shot to death?

      When a person is willing to break a law – they are criminals- simple- we do not want criminals roaming our streets! The borders – both of them need to be closed so that no one can come in illegally from Mexico – or from Canada that would cause us harm and that means no-one.

      We don’t care who the hell they are – they are not welcomed if they disobey the laws in getting in here! We also need to close loopholes so people don’t come in on Visa’s from other places that mean us harm – terrorists!

      Americans deserve to protect them homeland just as Mexico and Canada and every other country does!

  4. “All Men are created equal”! The founders had it right, when attempting to form a perfect union and they also knew that they were not there yet but knew we one day would get there. Lincoln moved us forward as did JFK and LBJ. This Nation was founded by men of many nations and backgrounds. It was founded on the principle that all men are created equal, and that the rights of every man are diminished when the rights of one man are threatened.

    It is my contention that this AZ law is not constitutional and will fail when challenged (unless, of course, they keep adding more amendments), pretty funny for this so called perfect law, that many internet bloggers claim it was copied “Word for Word” from the Federal law, which I frankly do not believe, if it was then no amendments would have been made, right?, of course, keep those lies coming.

    As for the undocumented workers, as was attributed to Ronald Reagan “It’s the Economy, Stupid”. When the economy is good we say let’s all celebrate “Cinco de Mayo, my brothers” but when the economy is down “it’s all your fault, you damn immigrant”. This too will pass, the real problem is the narcos, arms and people smugglers and that’s what the focus should be on.

    Don’t you find it funny that no one ever voted for Brewer for Governor, she is trying to get elected on the back of undocumented workers, it’s all about politics, do not be fooled. In the last few months Busy Brewer has passed S.B. 1070, no permit conceal weapons law, the famous Birthers law, banning Ethnic studies law, (could she be behind the Mural in Prescott, Arizona) and if history is a lesson and if she can read, she should look up Arizona’s House Bill 2779 from two years ago (which failed when legally challenged) and the craziest one the boycott of Martin Luther King Day, not wanting another holiday, how crazy is that. I believe there is an undercurrent to their enactment of new laws, they real love following a distinct pattern. Poor Brewer, in an attempt to gain sympathy, in an interview she first said her father had died in Germany fighting the Nazi in World War II (which ended 1945) and we find out her father was never in Germany and died in California in 1955 (watch her play the victim card, again) and then she went to Washington and came back empty as always, poor dear.

    • Benito – why do you keep spinning and spinning but never discuss the one thing I am talking about?

      Why is it that you refuse to discuss the word illegal?

      Why do you want to discuss what everyone else is doing wrong as though if one person breaks a law – then it is fine for others to do so? From your perspective then – I must ask – Why have any damned laws at all? I don’t condone the breaking of laws by politicians or anyone else and that is what the Tea party is about ! I am sick to death of you and others pointing out who is doing what and using that as an excuse for law breaking. And as far as All MEN are created equal – I absolutely agree however what do you mean by equal? For example some men are born blind does that mean you pluck out you eye and give him one of yours because God gave him only one eye? I hardly think so – better check what that means – some are less fortunate – god never meant that every man be blessed and have what every other man be blessed with and further while he created us all equal in his eyes that does not mean we are entitled to another’s sweat equity.

      There would be no incentive to work if it were not so. Read your Bible brother – read how God rewarded the one who took her talents and multiplied them tenfold rather than horde them or only double them. Law breakers are not welcomed in God’s house, coveting is against God’s laws as well as bearing false witness. So when you decide to start quoting God to me – you better think twice- Don’t talk to me about God created- because God despises and detests law breakers.

      Now do you want to talk about illegal immigrants and why we need to enforce immigration laws and secure our borders or do you want to keep dancing around other bullshit?   5. It is odd that there has been this big spike in right wing idiocy coming out of Arizona though. Texas has a higher background level of crazy and right now Arizona is like a supernova taking the attention. I wonder how long it will last.

    Actually it isn’t that strange. Arizona has been moving gradually towards the middle over the last twenty years. The population has doubled in that time and a big part of that spike wasn’t old retirees who tended to be conservative, but a lot of younger families moving from blue states, etc. In 2008 McCain only received 53.4% of the vote here in Arizona, his sixth lowest vote total among the states he won. Now think about that, his home state was one of his least supportive states. Had McCain been from Texas, Florida, etc., he likely would have lost Arizona.

    This state has a long history of very conservative, often racist politics and the supporters of those policies aren’t happy that they are consistently losing ground to moderates and liberals (simply termed as liberals in their tirades). Because of how the state legislature is set up conservatives still have a major majority in both houses but, when Napolitano was governor, she vetoed a lot of their stupidity. In fact she set the record for vetoes in the history of the state. You take her away, bring in Brewer who is a wing-nut’s wing-nut, and you see incredibly stupid legislation that was shut down by a reasonable governor make it out of the state house. At the same time you see an increase in non-conservative population as well as an increase in non-white population and the far white err, right is freaking out.
